monsoonal moisture sweeping across the bay area this morning even some lightning strikes in northern sonoma and mendocino counties. let's look at it on our hi-def doppler radar. you can see that as it's sweeping through now and looks like it will continue to pass on by this morning and then things beginning to settle down. now, the temperatures are going to stay hot partly cloudy around the bay area and some very mild to warm temperatures already 73 degrees in livermore right now. 68 in concord, 63 in san francisco. the heat warnings continuing for one final day. i think this is it. this will be the last hot day triple-digit temperatures expected again in some of the interior valleys as high as 101 in livermore, 98 concord, about 90 in san jose and 73 degrees in san francisco. we'll have more on your weather coming up. right now let's check the roads with elizabeth. >> easy breezy on the july 4th hol. if you want to ride bart in tonight for the 4th of july celebrations they will be offering a limited number of charter buses this morning so

you can check that out at several bay area stops east bay stops into the city but as you are, the roads look good now, as well. let's check the golden gate bridge. hey, not as much fog as we have seen in the past couple of days and traffic flowing nicely along southbound 101. back to you. >> thank you. today is a working holiday believe it or not for bart negotiators. they are meeting once again to try to sort out a contract with the bart union workers. kpix 5 reporter cate caugiran in walnut creek. not a big commuter day probably a good thing for folks. >> reporter: yes. it has to be. i'm sure a lot of commuters as it is a holiday are breathing a sigh of relief because we do know negotiations are going to resume at 11:00 this morning. as you mentioned it is a holiday so that really just goes to show you that both sides are really committed to finding a deal and getting these trains back up and running. what i can tell you about last night is that the talks went from 1:00 to 11 p.m.

last night. the groups took a brief break for dinner before walking back inside oakland's caltrans building. the two groups hunkered down for hours and without going into details, they say progress has been made. >> that's what's best. we want to make sure those conversations stay at the table so we can try to get a deal done as soon as possible. >> i apologize for the inconvenience of withholding our labor but somebody has to take a stand. >> reporter: take a look at this. in a new kpix 5/surveyusa poll, 23% say the union has made a better case but nearly double that 40% sided with bart management. perhaps that has something to do with the long lines this we have seen for these shuttles, ferries and traffic we have seen going into san francisco. but it is a holiday so commuters can breathe a sigh of relief and get a little bit of ease from the commuter chaos. live in walnut creek, we'll be right back. >> i think folks are a little bit sick of it but how -- do

you have any idea if they are closer to a deal or is it all that we're meeting that's it? >> reporter: we all would like to know what the details are but unfortunately, because of a gag order put in place by state mediators, both sides are not really talking about the details at the table. at this point we just have to assume that no news in this case is good news. >> they are meeting on a holiday, that's good news, as well. cate caugiran live for us in walnut creek, thank you, cate. bart employees are asking for more money. there are some people who are willing to work for less and they are ready to cross the picket line. jeffberger an unemployed former pilot picketed yesterday's negotiations with a sign asking bart to hire him. he says there are many more like him looking for a job. >> there's thousands like us up here either unemployed or underemployed who would be grateful for the opportunity as opposed to those people who are on strike right now. >> berger has created a facebook page asking bart to

hire him. grief counselors are called to a camp in the sierra nevada. a 21-year-old staff member was killed yesterday when a tree fell on her at camp tawonga in the stanislaus national forest. children were eating breakfast when the tree crashed to the ground just outside the danger hall trapping five counts. annais rittenberg was killed, four other adults were hurt. all the kids, though, are safe. >> it fell down and took down power lines. pg&e turned the power off and cal fire went in to remove portions of the trees to help get those people out that were injured. >> camp tawonga has 300 campers and 150 staff members at a time during the summer. it served jewish campers from the bay area since 1925. the u.s. embassy in egypt is ordering all nonessential person to leave the country immediately. the egyptian military took control of the government from the democratically elected president yesterday. cbs reporter tara mergener has

the latest developments now from egypt. reporter: tahrir square appears sleepy and calm this morning. but it was a different story last night as many egyptians celebrated the military overthrow of president mohamed morsi. today the work of replacing him begins. adly mansour the head of egypt's supreme court was sworn in this morning as the interim president until new elections can be held. >> i don't think anyone here wants the army to come back and govern the country. >> reporter: the egyptian military confirms they detained morsi after he called on supporters to protect his presidency. the army also surrounded islamist rallies to keep the peace but there has been some violence, with reports of dozens of people killed. the white house is closely monitoring the situation. president obama says he was deeply concerned about the egyptian army's decision to oust morsi. some of the president's top advisors arrived at the white house wednesday evening to

discuss the situation. egyptian military leaders assured the u.s. that a civilian government would take over quickly. america has budgeted $1.3 billion of aid for egypt this year with a majority of that money supporting the military. vermont senator patrick leahy, head of the committee that oversees foreign aid, says the u.s. shouldn't send another dime. our law is clear, he said. u.s. aid is cut off when a democratically elected government is deposed by military coup or decree. so far, president obama has been reluctant to call this a coup. in washington, tara mergener, kpix 5. >> egyptians living here in the bay area speaking out about the coup. many say president morsi had to go. they accused him of giving power to the "muslim brotherhood." they say what happened to morsi should be a warning to egypt's next leader. >> they will not take it laying down. so they will do everything in their power to make sure

whoever takes overliesens to the people. >> a great thing for our relatives there because now they are no longer treated as second class citizens. >> they hope a new constitution, parliament and president are in place very soon. a safety debate is overshadowing today's opening ceremony for the america's cup in san francisco. the teams from italy and new zealand are protesting the regatta director's recommendation about rudder elevators. they say the rule change is performance-related and nothing to do with safety but the regatta director says it will help sailors better control the pitch of the boat. members of the oracle team are standing by the regatta director's decision. they say the rule change doesn't put any team at an advantage over another. >> it's more talk. they are not going to gain anything out of this, you know? a bunch of people whining over frankly tiny rules that aren't going to change the outcome of

this race. >> a five-member jury is set to hear the other team's protest on the rudder rule on monday. but the first race happens sunday. 5:08. other headlines around the bay on this holiday, the state's largest medical marijuana dispensary will be around for at least another year. u.s. justice department is trying to shut down the harborside health center in the city of oakland. oakland sued to stop the closure in february. the lawsuit was dismissed, but yesterday a judge ruled the health center will remain open until the appeal is heard. two high-powered lawyers will go against each other in san jose suits to let the oakland as move to the south bay. major league baseball has hired san francisco attorney john keker to fight the antitrust suit. keker represented some of the baseball players during the federal steroids investigation and balco. san jose's suit was filed by a burlingame attorney. san francisco says happy birthday to sutro tower today. the tower started broadcasting 40 years ago.

busy today, huh? >> reporter: good morning, frank and anne. happy 4th. absolutely this island is already a flurry of activity. the first boat, the first ferries to bring visitors here don't start coming for about the next 20 or 30 minutes. but everyone is very prepared, very ready for this. they are expecting about 15 to 20,000 people to come visit the statue today so it will be a very busy day. but what better day to come visit the statue, what better day for re-opening than independence day? >> how is the new crown? >> >> reporter: it was only open for one day and then superstorm sandy came and so it had undergone this huge restoration project and so now it's open once again hopefully for a lot longer this time. but the new crown is great. it's safer, there's more space. there's better viewing areas. so those are some of the

improvements visitors will think when they come to the crown. a lot of the walkways and buildings are new. many of the changes that they have had to do in this $70 million project the last eight months. >> you're there. if folks have never been there, what's it like to stand under lady liberty rouse re. >> reporter: take the time to stand here and observe, we were all taking pictures and saying friends, family, post this on facebook. it's an incredible experience to be here to be some of the first people back on this

island as the statue of liberty reopens. >> awesome so back at home the bart strike continues. traffic shouldn't be so bad though since it's a holiday. >> especially now. >> elizabeth wenger has traffic. >> reporter: if you have to commute the good news is you won't see huge delays even at this time of the morning. the rest of this week we are seeing delays growing in the cash lanes. they turned the metering lights on shortly around this time yesterday. it is much lighter today than what we have been seeing. let's check the golden gate bridge. >> traffic is light into san francisco. couple of mass transit notes. of course, bart once again no service muni and caltrain are offering a typical sunday

schedule. that's traffic. for your latest forecast, here's lawrence. >> all right. got some subtropical moisture wrapping around that ridge of high pressure touching off some thunderstorms in parts of the north bay this morning. starting to wind down a little bit but you can see it's moving on through parts of the bay area. really well to the north, northern sonoma county but still could see a few showers maybe even a couple of lightning strikes there. otherwise it's going to be another hot day away from the immediate coastline and the bay. high pressure holding on weakening. the trough digs in tomorrow bringing in some much cooler air and coolest way down over the weekend. 108 in sacramento the possibility of more thunderstorms in the sierra nevada. watch out for that, as well. 73 degrees into monterey bay. computer models showing the

monsoonal moisture sweeping through and scooting out of town. what it doesn't show is fog developing along the coastline toward the fireworks time but i think we will see some fog out toward the beaches for your fireworks. in the meantime, the temperatures are going to be hot away from the coast. 96 degrees in morgan hill. 90 in san jose. about 88 in milpitas. east bay temperatures up into the triple digits again in many spots. inside the bay you will see enough of a sea breeze to keep the numbers down. 73 in san francisco. and 65 in daly city. next couple of days return to normal it will feel good more low clouds and fog on the way for the weekend temperatures dropping off before slightly warming toward the middle of next week. the official fireworks forecast coastal fog otherwise mild temperatures mid-60s into san francisco upper 70s in into san jose. >> that looks dicey for fireworks. >> it is approaching the immediate coastline but you get inside the bay you will see a beautiful display of fireworks. >> hooray. >> yeah. you can turn education to something fun that's a win-win.

>> absolutely. and designing robots is fun and that's what 100 bay area high schoolers got to do all part of robo nanza aspiring high-tech engineering. we think that's pretty cool. reporter: this is the arena and these are the creations, frisbee-launching robots. it's all part of robonanza17 bay area students first robotic teams showing off their creations in a competition to crown the top robot in the silicon valley. these launch creations were designed and built completely by the students. >> th giving a task to accomplish in six weeks, they have to prioritize the tasks and work to get it done so that will serve them well in industry when they will encounter the same thing. >> reporter: palo alto high's elizabeth midman is part of the space cookie team a nasa girl scouts sponsored squad. elizabeth says she could barely handle a hand drill two months ago. now listen to her. >> i have been the fabrication

director meaning that i see the process of taking our design of the robot and making it into the real parts that get bolted and welded into our robots. >> reporter: teams were judged on their engineering and designs, creativity and, oh, yeah, accuracy. the objective to launch as many frisbees through these wooden openings all remotely controlled, bull's eyes equal perfection. but in the end it really wasn't the score or the robots that made all these students big winners. >> i might become a computer scientist and work for some high-tech company and get really rich and then fund my own research. >> these engineers are building their hands on aspect, and we expect that in engineers. we expect this to be the next generation of silicon valley engineers. >> and don't think for a minute that they're not watching down there in the silicon valley. these kids are going to be the leaders of tomorrow. and by the way, a big tip of the cap to intuitive surgical out of sunnyvale.

area park? >> pathetic. >> just -- just horrible. >> the freak accident kills a counselor at a popular summer camp. >> there will be a space where the laughter usually was. >> from across the bay to around the world, the stories that matter on "kpix 5 news this morning. captions by: caption colorado comments@captioncolorado.com good morning, everyone. happy 4th of july. it's thursday, i'm frank mallicoat. >> i'm anne makovec. michelle has the morning off. it is 5:30. negotiators will spend the 4th of july trying to bring the bart strike to an end finally. kpix 5 reporter cate caugiran is in walnut creek. the trains are idle for a fourth straight day but the talks continue. any progress that you know of, cate? >> well, frank, anne, it's tough to tell at this point. we don't know the details of the negotiating process. state mediators have imposed a gag order on both sides but again, there is going to be a meeting scheduled today so that's got to be good news. now, that also means another day of bay area bart strikes.

negotiations will resume at 11:00 this morning at oakland's caltrans building. both sides were at the table for hours yesterday. the talks started at 1:00 yesterday afternoon lasting until 11:00 last night. at this point, the public's patience is wearing thin and unfortunately, it does not help their opinion of the unions. >> the longer the strike goes the danger is that commuters become more resistant to what the union is demanding. >> reporter: but even if both sides reach a deal today, we won't see these trains up and running until tomorrow. but the good news for this morning is that it is a holiday so we're not, hopefully, going to see those long lines for the shuttles or traffic jams as people are taking the day off. live in the east bay -- or in walnut creek, we'll be right back. >> thank you. i know both sides can't talk about it exactly what's going on during the negotiations but do we have an idea of the mood

from both sides? >> well, frank, that's a great question and, yes, there was a difference that we noticed as the negotiators were walking out of yesterday's meeting. both sides seemed pretty wall. there was no public bashing or finger-pointing which sort of goes to show really they are at the point where they want to finalize a new deal. >> get it done. and they are meeting on a holiday and that's great news. cate caugiran live for us in walnut creek this morning, thanks. a new kpix 5-surveyusa poll shows 23% of respondents say the union has made the better case during the dispute but nearly double that 40% sided with bart management. ac transit offering beefed up service today for the 4th of july holiday. the company is going to run 1 1 additional buses all day. the n, l and f lines will run every 15 minutes instead of every 30. the n, l line runs between oakland and san francisco and the f line runs between berkeley and san francisco. bus service look normal friday.

in egypt, a new president has taken over after the military ousted mohamed morsi. adly mansour will serve as the interim leader until a new president is elected by the country. a date for that vote has yet to be set. the military is said to have morsi and 12 presidential aides under house arrest. ecuador says it found a tiny microphone hidden at its embassy in london last month. they believe the bug was placed there to spy on wikileaks founder julian assange. assange has been living at the official building after he was granted asylum there last year. assange is trying to avoid extradition to sweden where he is wanted for sexual assault on two women. senators john mccain and lindsey graham are spending the 4th of july in afghanistan. the two republicans made the surprise visit. they led a reenlisting ceremony of a half dozen troops. forces are scheduled to leave afghanistan by the end of next

year. mccain is trying to get talks going to arrange a long-term american presence in the country. there was a memorial for the 19 fallen firefighters who died battling a wildfire in yarnell, arizona. hundreds of other firefighters who are right now in the front lines saluted the convoys while others placed flowers and teddy bears in honor of the elite hotshot crew. the town of prescott was still going to hold 4th of july celebrations and another memorial. nearly 600 firefighters are still fighting that fire which has burned 13 square miles and destroyed 129 homes. someone may be poisoning dogs in the twin peaks neighborhood. police say two dogs had to go to the e.r. after eating meatballs that someone left out. kpix 5 reporter da lin joins us with more on those treats that have sent the dogs to the hospital. da. >> reporter: yeah, that's right, anne. we're in the twin peaks, diamond heights neighborhood where neighbors apparently found some poisonous cooked

meatballs on the sidewalks and also some parks. now, take a look at the picture we have of a meatball. this is just one of the few meatballs that neighbors gathered out here. two dogs apparently ate the meatballs and were taken to the e.r. they got pretty sick. some of the meatballs were left on crestline and brunette streets in twin peaks and neighbors collected as many as they could find but suspect there are still some poisonous meatballs out in these two neighborhoods. and as you can imagine, those neighbors are pretty upset. >> just seems that someone would try to poison an animal, it's pathetic. >> it's like hearing on halloween they put bad stuff in children's candy it's horrible. >> reporter: the meatballs have been sent to uc-davis for

testing. it's early, not a lot -- no dog owners out for a walk with their dogs yet. this is a pretty busy area. in terms of residential areas, there are a lot of houses here. and then there's the glen canyon park. this is a popular spot for dogs. back to you. >> if somebody has brought his dog to the twin peaks diamond heights neighborhood what are the symptoms to look for? how can people tell if their dogs were exposed to the meatballs? >> reporter: vets say the two dogs that were poisoned taken to the emergency room showed signs of agitation, seizures and even hypothermia and hard time breathing. >> thank you, da lin. a lot of people want to see the fireworks in the sky. you better deliver. >> this is always tough, too

the blisters were oozing, and painful to touch. i woke up to a blistering on my shoulder. i spent 23 years as a deputy united states marshal and i've been pretty well banged up but the worst pain i've experienced was when i had shingles. when i went to the clinic, the nurse told me that it was a result of having had chickenpox. i wouldn't wish it on my worst enemy.

going to be another hot one outside. in fact, yeah, it's going to be amazing. monsoonal moisture sweeping around that ridge and that is sparking some thunderstorms outside today. we have seen some strikes especially in the north bay early on but making for a beautiful start to the day if you are heading out the door. otherwise, we are seeing some hot weather continuing away from the coastline and the bay. looks like for one last day the heat warnings continue and cooler weather on the way that temperature is going to drop. the subtropical moisture wrapping around the outside of that ridge sweeping across our skies making for a neat sunrise. it will stay hot in the valleys, 108 sacramento, 109 fresno, triple digits into yosemite with thunderstorms there, as well. for us clouds will disappear throughout the day. the concern will be tonight as we are going to see some of that fog developing out toward the coastline. temperatures though looking like this. 90 in san jose today. about 88 in milpitas. east bay temperatures up in the

triple digits again, 102 in brentwood. 101 in livermore and pleasanton. inside the bay 73 in san francisco. about 80 degrees in oakland. next couple of days we really start to cool down maybe a little below average over the weekend warming up monday and tuesday. your fireworks forecast coastal fog, otherwise great viewing for many spots inland. let's check the roads with elizabeth. thanks, lawrence. we are anticipating a very light morning commute because of the holiday. even though the bart strike does continue. if you are commuting today, you have to get to work, there is a limited number of charter buses available through bart at those four bart stops in the east bay, including el cerrito, walnut creek, dublin-pleasanton and fremont. five stops in the east bay into san francisco but they will not be offering as many due to the holiday. they are not offering charter buses by the way to see the

fireworks later on tonight. muni, caltrain, offering a sunday schedule today and ac transit is stepping up their typical holiday bus service between the east bay and san francisco. we haven't been able to see it this quiet in a while. everything is fine near the oakland coliseum. and it is also a similar story this morning over at the golden gate bridge. looks like the fog continues to creep in so visibility a factor but overall just a couple of headlights towards the city. that is traffic. back to you. a big rule change for california public schools is just a signature away. lawmakers passed a bill allowing transgender students k-12 to choose which restroom they use and which sports teams they join regardless of their gender. if the governor signs it california would be the first such state to have such a law. opponents say it conflicts with students' rights to privacy. a panel of federal judges said no to governor brown's request to delay the early release of nearly 10,000 prisoners.

the governor is ordered to release the inmates immediately or find another alternative for prison overcrowding. the state will now begin identifying those best qualified for the early release. in the latest decision, the judges rejected the governor's argument in a releasing inmates will endanger the public. opening ceremonies for the america's cup regatta are today and still the fight over a recent rule change remains. the teams from italy and new zealand are protesting the regatta director's recommendation regarding a new required elevator. they say the rule change is performance related and has nothing to do with safety but the regatta director says the measure will help sailors better control the pitch of the boat. >> it's balancing the forces of a complex machine. they are sailing a combination of a submarine, destroyer and fighter plane. you try and make all them work together. that's what those guys have to do. >> the five-member jury will discuss it on monday.

the opening ceremony is today at 3:00. the first race of the louis vuitton cup is sunday. city college of san francisco's accreditation is revoked. the accrediting commission for community and junior colleges made that decision yesterday. that means that the state's largest community college does not meet program criteria. college officials have tried to turn things around since last july when the school was sanctioned for several violations including fiscal mismanagement. >> we follow their advice to the letter, and still is it wasn't enough. i mean, the changes at city college are massive. they are massive. the cuts were massive. >> the commission says it gave city college 14 recommendations for change and only two were fixed. classes will go on until next june and will then shut down. the decision could be appealed. until then a trustee will be appointed to run the college and the current board of trustee will not have any say in the running of the school.

the gold striker california's great america is back. the park shut down its newest roller coaster after people in nearby office buildings complained about all the screaming. as kpix 5's kiet do tells us, park workers made adjustments to muffle the noise. >> reporter: does the new sound tunnel work? listen for yourself. [ screaming ] >> reporter: it's a 70-foot enclosure built to cover a dip near the beginning. ride. engineers say screams coming from this section traveling about 500 feet to this nearby office building causing the noise levels here to slightly exceed their limits. >> the gold striker is closed today. >> reporter: great america took the unusual step of shutting down its flagship coaster for 2.5 days to build a tunnel in time for the holiday weekend. standing under it we measured the sound levels with an iphone appear and got 88 decibels and then the noise
